In four of the final written decisions, the board determined that ResMed failed to prove the challenged claims were unpatentable. A fifth petition was denied institution entirely, leaving ResMed with only a single successful challenge out of the six initiated. These administrative rulings specifically addressed patentability rather than infringement or damages, leaving the primary litigation in district court unaffected.
Robert N. Schmidt, Chairman and CEO of Cleveland Medical Devices, stated that the results reinforce the strength of the company’s portfolio. The firm currently holds 44 patents related to sleep therapy and testing, which remain the subject of active infringement claims in Ohio and separate proceedings in Delaware. Cleveland Medical Devices intends to pursue these cases as the district-court litigation moves forward.
