ANI Pharmaceuticals Challenges Delaware Court Ruling Over Asset Dispute

ANI Pharmaceuticals is taking its legal battle with CG Oncology to the Delaware Supreme Court after a local judge rejected the company’s bid to overturn an earlier verdict. The dispute centers on a 2010 asset sale agreement and a contested claim for royalties on a high-stakes cancer treatment.

Judge Sheldon K. Rennie denied the company’s post-trial motions, which had sought both a new trial and a judgment as a matter of law regarding an unjust enrichment claim. Despite the setback, ANI Pharmaceuticals remains firm in its pursuit of compensation for assets divested over a decade ago.

Chief Executive Nikhil Lalwani stated that the firm will continue to press for a 5% running royalty on all future global sales of cretostimogene grenadenorepvec. The appeal marks a significant escalation in the ongoing litigation, as ANI seeks to secure long-term financial interest in the development of the drug.
