Washington Judge Rules Against Kalshi Prediction Market

Washington state judge John McHale has ruled that Kalshi’s online prediction platform likely violates local gambling laws, granting the state attorney general’s request for a preliminary injunction. The decision sets a firm deadline for the company to address the court's concerns regarding the legality of its operations by August 5.

McHale’s ruling centers on the potential for immediate harm to consumer rights, noting that the state demonstrated a well-grounded fear of illegal activity. While the judge acknowledged the company's position, he maintained that the Commodity Futures Trading Commission’s federal oversight does not preempt Washington’s specific gambling statutes. He noted that contract legality remains a matter of state-by-state variance rather than federal exclusivity.

This legal clash highlights a broader confrontation between state regulators and prediction markets, including rivals like Polymarket. The CFTC, led by Michael Selig, continues to assert that it holds sole authority over these platforms, having previously challenged similar enforcement actions in New York, Arizona, Illinois, and Connecticut. For now, Kalshi must navigate the specific terms of the injunction, which are expected to be finalized early next month.
