Marc Mysterio Challenges Sony Music Over Excluded Artist Damages

Musician and producer Marcel Albert, known as Marc Mysterio, has filed an intervention in the Southern District of New York, alleging that Sony Music arbitrarily excluded major artists from a $21.2 million default judgment against Rhapsody International. Mysterio claims the judgment omits catalogs from Shakira, Jennifer Lopez, and Aerosmith.

The filing in Case No. 1:25-cv-06352-LAP argues that the February 2026 judgment, which awarded Sony $9.2 million in actual damages and $12 million in statutory damages, fails to account for numerous infringed works. Mysterio asserts that his own catalog, along with those of other high-profile artists, was improperly sidelined during the legal proceedings. He is now seeking a charging lien and a discovery process to identify all tracks impacted by the alleged copyright infringement.

Beyond the specific financial dispute, the motion highlights a broader tension regarding legal standing for artists. Mysterio points to a March 2026 ruling that established an artist's right to sue digital service providers directly as third-party beneficiaries. He suggests that if the court does not address the omissions, he will coordinate with artists like Shakira and Steven Tyler to pursue further action against Sony under New York law. The case remains before Judge Loretta A. Preska, with Mysterio also calling for an in camera review of evidence he characterizes as documentation of internal bribery and payola practices at the label.
