Jennifer Lipe, Benjamin Brewer, and Rhoderick Coleman died in the wreckage, while two others sustained injuries. Evidence presented at trial revealed that federal regulators had flagged Lupus Superior for unsafe driving for over a year prior to the incident.
Despite these documented warnings, C.H. Robinson continued to utilize the carrier. On the night of the crash, the driver reportedly informed both companies that he was too ill to continue operating the vehicle, yet he was pressured to press on with the delivery. Attorneys from Arnold & Itkin and Lyons & Simmons argued that the freight giant’s negligent hiring practices directly contributed to the loss of life. This decision follows the Supreme Court’s unanimous ruling in Montgomery v. Caribe Transport, which established that families have legal standing to hold brokers responsible for hiring unsafe motor carriers.
