Burford Capital Reports $600 Million Arbitration Award in Cameroon Case

An ICC International Court of Arbitration tribunal has issued an award exceeding US$600 million in favor of a Burford Capital counterparty. While the firm estimates its potential entitlement at more than AUD$250 million, the actual recovery remains subject to significant legal hurdles and collection risks in international jurisdictions.

The award marks a milestone for the litigation finance firm, with Burford noting that any potential proceeds would accrue directly to its balance sheet rather than its investment funds. However, the company emphasized that the current figure does not represent cash in hand. The matter remains vulnerable to annulment requests, set-aside proceedings, and complex enforcement challenges that often plague international arbitration outcomes.

Burford issued the statement preemptively, anticipating a public disclosure from its counterparty. Management cautioned that the final recovery could be materially lower than the initial award amount, or result in a total loss, depending on the success of post-award litigation and potential settlement negotiations. The firm maintains that it is under no obligation to provide ongoing updates as the legal process unfolds in various jurisdictions.
