San Diego Law Firm Targets MC Contracting in PAGA Labor Suit

Employees at MC Contracting were allegedly denied mandatory meal and rest breaks, prompting a lawsuit filed by Blumenthal Nordrehaug Bhowmik De Blouw LLP in San Diego County Superior Court. The action seeks civil penalties under California’s Private Attorneys General Act for a laundry list of state labor code violations.

The complaint, registered as Case No. 26CU032502C, claims that workers were frequently required to labor beyond four-hour stretches without the ten-minute rest periods mandated by state law. These lapses allegedly forced staff to work off the clock, resulting in uncompensated hours and inaccurate payroll records. By failing to provide off-duty time free from employer control, the firm argues that MC Contracting effectively bypassed core requirements of the California Wage Order.

This litigation utilizes the Private Attorneys General Act (PAGA), a mechanism that allows employees to step into the role of state enforcement agents. Unlike standard class actions focused on individual restitution, this suit aims to recover civil penalties for the state. Blumenthal Nordrehaug Bhowmik De Blouw LLP represents the plaintiffs in this enforcement action, which highlights ongoing scrutiny of labor practices across the company’s operations.
