Hometown Equity Mortgage Faces Representative Action Over Wage Claims

San Diego labor attorneys at Zakay Law Group have initiated a representative action lawsuit against Hometown Equity Mortgage, accusing the lender of systemic wage theft. Filed in the San Diego County Superior Court, the complaint alleges the company deprived staff of overtime, meal breaks, and essential expense reimbursements.

The litigation, registered as Case No. 26CU040038N, contends that the mortgage firm violated numerous sections of the California Labor Code. Central to the allegations is the claim that employees were coerced into performing work before and after their scheduled shifts, as well as during mandated off-duty meal breaks. This alleged 'off-the-clock' work left staff undercompensated for time spent under company control.

Beyond basic overtime violations, the suit asserts that Hometown Equity Mortgage failed to maintain accurate payroll records and neglected to provide compliant itemized wage statements. The firm is further accused of failing to pay correct sick time and withholding wages due upon termination. Under state law, employers are required to pay at least the minimum wage for all hours during which an employee is permitted to work, regardless of whether that labor was formally requested.
