According to the complaint, this timing allowed executives to engage in insider trading before the market realized the deception. The filing claims these actions rendered the company's public statements regarding its operations and financial health materially false and misleading.

Those who purchased HYLN securities during the specified period have until October 27, 2026, to petition the court to serve as lead plaintiff. While the case is currently active, no class has been certified, meaning investors are not yet represented by counsel unless they choose to retain their own. Participation in potential future recoveries does not strictly require serving as a lead representative, and investors may remain absent class members if they prefer.
