The litigation alleges that Simply Good Foods misled shareholders regarding the integration of Only What You Need, Inc. (OWYN). According to the suit, the company failed to disclose the departure of critical management personnel and significant product quality issues stemming from a new pea protein supplier. These internal failures reportedly led to a bloated organizational structure, damaged distributor relationships, and declining sales, despite aggressive promotional discounting that eroded profit margins.
Shareholders may participate in the case without upfront costs through a contingency fee arrangement. While a class has not yet been certified, those interested in serving as a lead representative must move the court by the October 13 deadline. Investors retain the right to select their own counsel or remain absent class members, as the ability to share in any potential recovery does not require taking a lead role in the proceedings.
