Investors who purchased ARS Pharmaceuticals securities between March 9 and June 24, 2026, face an October 5 deadline to file for lead plaintiff status in a pending securities fraud lawsuit. The litigation centers on claims that the company misled shareholders regarding the insurance coverage timeline for its epinephrine nasal spray, neffy.

The lawsuit alleges that defendants issued overly optimistic projections concerning an expanded insurance agreement with CVS Caremark, specifically asserting that coverage would commence on July 1, 2026. Plaintiffs contend these statements were materially false or omitted adverse facts, leading shareholders to acquire stock at artificially inflated prices. The complaint suggests that when the actual status of the coverage became apparent, the resulting market correction caused significant financial losses for investors.

Rosen Law Firm, which filed the action, is currently soliciting participants for the class. Potential lead plaintiffs must move the court by the October 5, 2026, cutoff. While the firm encourages investors to secure legal representation, no class has been certified yet. Investors retain the option to select their own counsel, remain absent members, or take no action at this stage, as eligibility for future recovery does not strictly depend on serving as a lead representative.
