Under the National Defense Authorization Act, these ties categorize Alibaba as a Chinese military company, a status that was not revealed to the market during the class period of June 26, 2025, through June 24, 2026.

Investors suffered losses following two major disclosures. In June 2026, the U.S. Department of Defense officially added Alibaba to its list of military-linked firms, triggering a 3.9% drop in share price. Shortly after, reports emerged that Alibaba had allegedly accessed Anthropic’s Claude AI models through thousands of fraudulent accounts to conduct distillation attacks. This revelation caused a further 4.7% decline in Alibaba ADSs. Reed Kathrein, a partner at Hagens Berman, stated the firm is investigating whether executives intentionally concealed these risks to misrepresent the company’s competitive standing.
