California Pushes Toward Ban on High-Silica Artificial Stone

California regulators are moving to prohibit the fabrication and installation of artificial stone containing over 1% crystalline silica, responding to an escalating public health crisis. The proposed ban targets a material linked to hundreds of cases of incurable, fatal silicosis among countertop workers across the state.

The regulatory shift, highlighted in a recent San Francisco Chronicle report, follows mounting evidence that existing safety measures—such as wet-cutting and specialized respirators—fail to protect workers from the hazardous, nano-sized dust generated during fabrication. Engineered stone, which typically contains at least 90% crystalline silica, has been labeled uniquely toxic by occupational health experts. Since 2019, California has recorded 662 cases of silicosis related to the material, resulting in 35 deaths and 75 lung transplants.

James Nevin, a partner at Brayton Purcell LLP, which represents approximately 600 affected workers, argues that the industry cannot be made safe for human labor. Epidemiologist David Michaels echoes this concern, describing the situation as a national epidemic that demands urgent intervention. While the proposed rule would effectively remove artificial stone from the California market, safer alternatives like porcelain, laminate, and butcher block remain available for residential and commercial design projects.
