Texas Jury Awards $21.6 Million After Home Defects Trigger Toxic Exposure

A Tarrant County jury has ordered contractor NAE Enterprises to pay $21.6 million to the McCoy family, ruling that the company knowingly ignored critical construction defects. The verdict concludes a harrowing legal battle for the family, who were forced to abandon their home due to toxic sewer gas and mold.

Ronny and Mandy McCoy first flagged a pervasive, foul odor in their home shortly before closing in 2018. Years later, a professional inspection revealed the source: plumbing vents had been improperly terminated directly into the attic, venting sewer gas throughout the residence. The family, who suffered from chronic respiratory issues, dizziness, and migraines, eventually evacuated the property on the advice of the Texas State Board of Plumbing Examiners. They have lived in an RV on their property ever since.

During the trial, attorneys from Just Well Law presented evidence of severe foundation flaws and moisture intrusion that fueled extensive mold growth. Jurors found NAE Enterprises liable for gross negligence, citing intentional violations of the Deceptive Trade Practices Act. The $21.6 million award includes $10 million in exemplary damages. While the jury assigned 77 percent of the responsibility to NAE Enterprises, they also held Dauenhauer & Associates and Ricky Dauenhauer accountable for the remaining share of the damages. The verdict serves as a sharp rebuke to construction shortcuts that prioritize profit over the fundamental safety of residential inhabitants.
