Florida Couple Files First Lawsuit Over Publix E. Coli Outbreak

After months of medical treatment following a severe E. coli infection, Oscar and Roberta Cash have launched the first lawsuit against Publix. The couple fell ill in May 2026 after consuming GreenWise Organic blueberries, a product now linked to a multistate outbreak of the O145:H28 strain of the bacteria.

The legal action, filed in Palm Beach County by Ron Simon & Associates and Elizabeth Zwibel Law, details a harrowing health ordeal for the couple. Roberta Cash required ten days of hospitalization at Jupiter Medical Center followed by nearly three weeks of rehabilitative care at The Gardens Court nursing facility. She continues to receive ongoing treatment for symptoms including bloody diarrhea and severe dehydration.

According to federal health authorities, the outbreak has sickened at least twelve people across Florida and Georgia. The tainted fruit, supplied by Chile-based Frutas y Hortalizas del Sur S.A., was distributed across eight states. Attorney Ron Simon, who represents the couple, claims the contamination occurred due to missed safety checks during production. His firm has established a dedicated claim center to assist other affected consumers as they seek to determine how the bacteria bypassed quality controls.
