Jury Awards $21 Million After Bakersfield Tow Truck Collision

A Kern County Superior Court jury has awarded a $21.3 million verdict to Luis Luna Jr., a motorist severely injured when a flatbed tow truck executed a three-point turn across State Route 65. The decision holds the trucking company liable for the 2026 collision, resulting in a $12.8 million net payout.

The accident occurred when a flatbed tow truck blocked the highway for 14 seconds, leading to a collision that left Luna with multiple fractures, spinal fusion at L5-S1, and a torn ACL. Complications from surgical hardware in his leg required secondary intervention, further compounding his recovery. While the defense argued that Luna was inattentive or fatigued, attorneys Shawn McCann, Jesse French, and Garret Valerio of BD&J successfully countered that the truck driver’s maneuver was the primary catalyst for the crash.

The litigation process was marked by a significant disparity between the parties' valuations. Despite the defense's initial $100,000 offer and subsequent denials of a $1 million policy-limit settlement, the jury ultimately sided with the plaintiff. The verdict includes $19 million for pain and suffering and over $2.3 million for medical expenses. With additional interest and litigation costs, the final recovery reached more than ten times the amount Luna originally sought in his statutory demand.
