Investors File Securities Fraud Class Action Against PROCEPT BioRobotics

A securities fraud class action lawsuit now targets PROCEPT BioRobotics Corporation, alleging the medical technology firm misled shareholders regarding product demand. Investors who purchased common stock between February 28, 2024, and February 25, 2026, have until September 22, 2026, to petition for lead plaintiff status in the federal case.

The complaint, filed in the United States District Court for the Northern District of California under the caption Operating Engineers Construction Industry and Miscellaneous Pension Fund v. PROCEPT BioRobotics Corporation, contends that the company artificially inflated its financial performance. According to the allegations, PROCEPT incentivized bulk orders through an undisclosed discount program, which led to a significant overstocking of its Aquablation therapy handpieces. This practice reportedly created a disconnect between reported sales figures and actual clinical procedure demand.

The discrepancy surfaced on February 25, 2026, when the company revealed that handpiece sales had consistently outpaced actual usage since early 2023. Following this disclosure, PROCEPT stock dropped more than 18%. Law firm Kessler Topaz Meltzer & Check, LLP is currently advising affected shareholders on recovery options, noting that the litigation seeks to address the material misstatements regarding the firm's business prospects and operational health.
