The lawsuit, Wistisen v. Alibaba Group Holding Limited, centers on allegations that the company concealed its affiliation with the Chinese Ministry of Industry and Information Technology (MIIT). According to the complaint, these omissions left investors unaware that Alibaba was classified as a Chinese military company under the National Defense Authorization Act (NDAA). The firm Hagens Berman claims this regulatory vulnerability, combined with reports of unauthorized "distillation" attacks on Anthropic’s Claude AI models, artificially inflated the stock price during the class period from June 26, 2025, to June 24, 2026.
Market reactions were sharp following two key disclosures. On June 8, 2026, the U.S. Department of Defense added Alibaba to its list of Chinese military companies, triggering a 3.9% decline in share value. Later that month, reports surfaced that Alibaba allegedly used thousands of fake accounts to scrape Anthropic’s AI technology. This second revelation caused shares to drop an additional 4.7% by June 25. Reed Kathrein, the Hagens Berman partner leading the investigation, stated that the firm is scrutinizing whether executives intentionally masked these operational risks to maintain the company’s perceived competitive position.
