Hims & Hers Health Faces Class Action Over FTC Misconduct Allegations

Investors have launched a securities class action against Hims & Hers Health following a federal complaint by the FTC that accuses the telehealth provider of deceptive data practices and predatory billing. The lawsuit, filed in the wake of a sharp stock decline, centers on allegations of unauthorized health data sharing.

The legal action targets Hims & Hers Health (NYSE: HIMS) for allegedly misleading stakeholders regarding its internal safeguards and business ethics. According to the complaint, the company shared sensitive medical data with third-party advertising platforms like Meta and Snap while simultaneously enrolling consumers in recurring subscription models without clear consent. Plaintiffs claim that customers were often billed for prescriptions before ever consulting a medical provider, a practice regulators argue violates the Restore Online Shoppers' Confidence Act.

These revelations triggered a significant market sell-off on July 29, 2026, when Hims shares plummeted 14.7%, erasing nearly $970 million in market capitalization in a single session. The law firm Hagens Berman is currently spearheading the investigation into whether the company intentionally obscured the financial risks associated with these regulatory failures. Investors who suffered losses during the class period of August 4, 2025, through July 29, 2026, are encouraged to come forward before the November 2, 2026, deadline to serve as lead plaintiff.
