The complaint, captioned Hatweek v. Fluence Energy, Inc. et al., asserts that the energy storage provider misrepresented its capacity to fulfill surging demand from data centers. While Fluence publicly touted contracts with multiple production facilities, the lawsuit claims several of these sites remained incomplete or incapable of meeting the manufacturing volumes promised in the company’s revenue and EBITDA guidance.
Fluence’s financial disclosures throughout 2026 revealed a pattern of production setbacks. Following a February announcement of a $62.6 million net loss, shares dropped sharply. Subsequent updates in August and September further slashed revenue expectations, citing ongoing delays in the ramp-up of contract manufacturing operations. Investors impacted by these declines have until November 27, 2026, to petition the U.S. District Court for the Southern District of New York to serve as lead plaintiff in the action brought by Bleichmar Fonti & Auld LLP.
