Brazil's Data Center Expansion Stalls Amid Regulatory Gridlock

Brazil’s ambition to become a global hub for high-performance computing faces a stark reality check, as Rystad Energy slashes the country’s projected data center pipeline from 21 GW to 7 GW. Success now depends on a complex alignment between the newly elected Congress and the executive branch on tax and energy policy.

Brazil's Data Center Expansion Stalls Amid Regulatory Gridlock

The Redata tax regime, established under Law No. 15,504/2026, serves as the primary instrument for attracting hyperscale investment. However, these tax incentives remain contingent on strict operational benchmarks that are currently undefined. Investors are waiting for clarity on whether natural gas generation qualifies as low-emission power, alongside unresolved requirements for local content and energy-efficiency metrics. Beyond these policy gaps, severe grid congestion and limited access to reliable electricity have significantly elevated the risk profile for new developments.

While the government moves forward with executive-led initiatives—such as the Fuel of the Future program for biofuels and the Rehidro framework for hydrogen—data center infrastructure requires legislative action to bridge the gap between tax deadlines and regulatory standards. Congressional progress on grid reform, specifically the reallocation of battery storage integration costs via PL 3716/2026, remains a critical milestone ahead of the ANEEL capacity auction scheduled for December. Without precise coordination between lawmakers and the executive branch, Brazil risks falling behind in the race to secure the massive energy supplies required for its AI and high-performance computing ambitions.
