The legal action asserts that Action Day Schools failed to comply with numerous California Labor Code statutes, including sections governing minimum wage, overtime compensation, and accurate record-keeping. According to the filing, the company’s internal staffing levels and rigorous work demands frequently forced employees to work through required ten-minute rest periods. The suit claims staff were denied breaks during shifts ranging from two to over ten hours, often without receiving the mandatory one-hour wage penalty required by state law when breaks are skipped.

Beyond rest period disputes, the lawsuit alleges the employer failed to reimburse staff for necessary business expenses and prevented employees from inspecting their own personnel records. The case, identified as Case No. 26CV493374, seeks to address a pattern of alleged wage theft and administrative non-compliance.
