The litigation, pending in the U.S. District Court for the Northern District of Illinois, targets Atkore Inc. and several affiliated brands, alongside Northern Pipe Products and Vinyltech Corporation. Plaintiffs allege these companies conspired to artificially inflate prices for PVC pipe, violating federal and state antitrust laws. Under the terms of the agreement, Atkore will contribute $50 million, while Northern Pipe and Vinyltech will pay $30 million. These funds are intended to resolve claims for the end-user class while providing ongoing cooperation against remaining defendants.
Class members who do nothing remain part of the settlement and may be eligible for future payments, though they forfeit the right to pursue individual litigation against the settling companies. Those wishing to opt out must submit a postmarked exclusion request by September 8, 2026. The court has scheduled a fairness hearing for October 1, 2026, at the Everett McKinley Dirksen Federal Courthouse in Chicago to evaluate the adequacy of the agreements and address potential objections.
