Bafin expands oversight of AI systems in German finance

German financial regulator Bafin has secured new legislative authority to police the deployment of artificial intelligence across the nation's banking and insurance sectors. Starting this week, the watchdog will scrutinize how companies utilize automated systems to ensure compliance with transparency standards and the protection of fundamental consumer rights.

The agency’s mandate now includes the power to issue fines for non-compliance, specifically targeting high-risk applications such as creditworthiness assessments and customer-facing chatbots. By monitoring these systems, Bafin aims to prevent the use of prohibited AI practices, particularly those involving the collection of sensitive data that might subject individuals to unfair disadvantages.

Bafin President Mark Branson emphasized that the priority is maintaining public trust in financial services. The regulator will actively enforce rules to guarantee that algorithms do not inadvertently introduce discriminatory barriers, ensuring equitable access to financial products regardless of how internal automated processes are structured.
