Bayer Sues Johnson & Johnson Over Prostate Cancer Drug Claims

Bayer has filed a lawsuit against Johnson & Johnson and its Janssen Biotech unit, alleging the pharmaceutical giant used deceptive marketing to promote its prostate cancer treatment, Erleada. The legal challenge disputes J&J's claims that its drug is superior to Bayer’s competing therapy, Nubeqa, marking a significant escalation in the competition for dominance in the oncology sector.

The conflict centers on a study J&J publicized earlier this month, which claimed Erleada caused a 51% reduction in the risk of death for patients with metastatic castration-sensitive prostate cancer when compared to Nubeqa. According to the report, these results applied to patients not concurrently using the chemotherapy drug docetaxel. Bayer, however, characterizes these assertions as being built on "scientifically flawed data" rather than a legitimate clinical comparison.

Disputed Methodology and Scale

Bayer’s complaint argues that J&J failed to conduct a true head-to-head clinical trial, instead relying on an analysis that neglected critical prognostic factors. The German company claims the study did not adequately measure baseline characteristics, such as non-cancer comorbidities, which are essential for determining a drug's true efficacy in a diverse patient population.

Furthermore, the lawsuit highlights a significant imbalance in the data sets used for the comparison. Bayer alleges that the patient population analyzed for Erleada was five times larger than the group taking Nubeqa, a discrepancy that Bayer argues invalidates the comparative findings.

In a statement addressing the litigation, Johnson & Johnson defended its findings. The company stated that it stands by the "rigor and integrity" of its real-world, head-to-head analysis, setting the stage for a legal battle over pharmaceutical advertising standards.
